Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.)

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day,

• on which you or a third party designated by you, who is not the carrier, have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered together; or
• on which you or a third party designated by you, who is not the carrier, have taken possession of the last item, provided that you have ordered several goods as part of a single order and these are delivered separately; or
• on which you or a third party designated by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, provided that you have ordered goods that are delivered in several partial shipments or pieces; or
• on which you or a third party designated by you, who is not the carrier, have taken possession of the first item, provided that you have entered into a contract for the regular delivery of goods over a fixed period.

To exercise your right of withdrawal, you must inform us (WSW Profiltechnik GmbH, Alte Gissigheimer Str. 5, 97953 Königheim, Germany, Phone: +49 9341-8589032, Email: info@equistair.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising your right of withdrawal before the withdrawal period has expired.

Exclusion of the Right of Withdrawal for Personalized Engravings

Please note that the right of withdrawal is excluded under Section 312g(2)(1) of the German Civil Code (BGB) for contracts involving the delivery of goods that are made to customer specifications or are clearly tailored to personal needs. This includes EquiStair stirrups with personalized laser engraving, as they are custom-made according to your specific request. Therefore, withdrawal after engraving is not possible.

The general withdrawal period for other, non-personalized products remains unaffected.

Consequences of Withdrawal

If you withdraw from this contract, we must reimburse all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

For this repayment, we will use the same payment method that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

Return Shipping Costs and Country-Specific Regulations

You are responsible for the direct costs of returning the goods unless:

• the delivered products are defective,
• the goods do not match the description, or
• it is a case of warranty claims.

The following country-specific regulations apply:

• France: According to French consumer protection law, we will cover the return shipping costs only if required by national legal provisions and if the return is due to a defect or a deviation from the product description.
• Spain: If Spanish consumer protection law requires the seller to cover the return shipping costs for defects or warranty claims, this will be appropriately considered.

Liability for Diminished Value

You are only liable for any diminished value of the goods if this diminished value is due to handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
